We may also offer custom services, project-based engagements, or separately priced add-ons.
Any custom pricing and deliverables will be disclosed and agreed upon before the relevant purchase.
Advertising spend is separate from our agency management and setup fees.
Recommended advertising budgets are recommendations, not additional fees payable to Infinity Digital Solutions LLC.
4. Advertising Budgets and Third-Party Expenses
Unless expressly agreed otherwise, customers pay their advertising budgets directly to the relevant platforms, including Google, Meta, or Microsoft.
Advertising management fees compensate Infinity Digital Solutions LLC for professional services and are not payments for advertising traffic.
Additional third-party expenses may include:
- CRM or software subscriptions
- Website hosting and domain registration
- AI voice or messaging usage beyond included allowances
- SMS, telephone, or email usage beyond included allowances
- Specialized software, integrations, and external tools
- Additional services requested by the customer
We disclose applicable third-party costs or explain how they are calculated before customers authorize them.
We will not add undisclosed agency management fees to customer advertising costs.
Where we manage Google Ads, we will provide appropriate access to advertising cost and performance information and distinguish Google advertising charges from our professional service fees.
5. AI Services and Included Usage Allowances
Our growth packages may include AI-powered lead handling, automated messaging, appointment assistance, and related CRM technology.
Standard AI usage is included within the applicable package's published limits.
Our currently published monthly allowances are:
Silver
- Up to 100 AI voice minutes
- Up to 1,000 AI conversation responses
Gold
- Up to 100 AI voice minutes
- Up to 1,000 AI conversation responses
Platinum
- Up to 300 AI voice minutes
- Up to 3,000 AI conversation responses
Usage limits apply to the corresponding monthly service period.
Additional AI minutes, messages, telecommunications services, or other usage beyond the included allowance may incur additional charges.
Any applicable usage rates or additional charges will be communicated before the customer authorizes that additional usage.
Customers may elect to purchase additional usage or remain within their included package limits where technically supported.
We will not intentionally activate chargeable additional usage without appropriate customer authorization.
AI-based services may produce inaccurate or incomplete responses and are not a substitute for appropriate human oversight.
6. CRM and Software Subscription Options
Customers may use CRM and automation services through one of two arrangements.
Option A: Agency-Managed CRM
The customer uses a supported CRM subaccount managed through Infinity Digital Solutions LLC.
The access, features, included usage, and monthly service arrangements are determined by the purchased package or agreement.
Features and services that depend on our agency-managed hosting or subscriptions may stop operating when the applicable service ends.
Option B: Customer-Owned CRM Subscription
The customer maintains a separate subscription with the CRM or software provider and pays the provider directly.
Infinity Digital Solutions LLC may provide setup, configuration, management, or automation services under a separate agreement.
The customer is responsible for maintaining applicable third-party subscriptions and payment obligations.
We explain the relevant differences in ownership, subscriptions, and ongoing costs before implementation.
7. Ownership of Customer Accounts and Work
We believe customers should have appropriate ownership and control of the business assets created for them.
Unless otherwise agreed:
- Customers retain ownership of their business information, branding materials, and customer data.
- Advertising accounts established in the customer's name remain under their control.
- Customer-provided domains, websites, business profiles, and related assets remain customer-owned.
- Final custom deliverables created specifically for a customer are transferred or licensed to the customer according to the agreed service terms upon full payment for the relevant work.
- Third-party software, licensed assets, and subscription-based technology remain subject to their providers' terms.
- Our preexisting templates, methods, reusable systems, and proprietary tools remain our intellectual property.
We do not claim ownership of customers' independently owned advertising accounts or business information simply because we manage them.
We encourage customers to maintain appropriate administrative access to their own advertising and business accounts.
8. CRM Handover and Customer Freedom
Customers are free to end their business relationship with Infinity Digital Solutions LLC according to the applicable cancellation terms.
We do not believe in holding customer accounts, customer data, or eligible client-specific configurations hostage when a customer chooses another provider.
Upon termination, customers may request available copies or exports of eligible customer-owned data and client-specific configurations.
Where technically supported, we will facilitate a reasonable handover, including an available GoHighLevel snapshot or equivalent supported configuration export.
We do not charge a separate punitive exit fee or demand an additional payment solely for providing an available client-specific snapshot as part of a normal handover.
HighLevel snapshots generally contain selected configuration assets rather than live customer records. Contacts, conversations, appointment history, integrations, payment connections, and certain other assets may require separate export or transfer procedures.
A snapshot does not guarantee that every feature will function automatically in a different account.
The receiving account may require compatible subscriptions, integrations, phone numbers, licensing, or configuration work.
We will reasonably cooperate in transferring eligible customer-owned assets, subject to platform functionality, lawful permissions, and applicable third-party requirements.
Customers remain responsible for independent third-party subscription charges or services they choose to establish after departure.
Ending a service relationship does not eliminate legitimate unpaid charges for previously authorized and completed services.
9. Payments and Billing
Payments may be collected using Stripe, PayPal, bank transfer, electronic invoices, or other accepted methods.
Depending on the customer's agreement, billing may include:
- One-time setup payments
- Automatically recurring monthly subscriptions
- Manually issued monthly invoices
- One-time project fees
- Separately authorized add-on charges
Payment methods, applicable amounts, billing frequencies, and due dates are disclosed before purchase.
Recurring payments will be collected only when the customer has authorized the subscription or recurring payment arrangement.
Monthly service fees are generally charged at the beginning of the applicable billing period unless a different schedule has been agreed.
Setup fees are generally charged before the implementation work begins.
Any applicable taxes are disclosed as required.
10. Month-to-Month Services and Automatic Renewals
Unless a separate written agreement states otherwise, our standard recurring services operate on a month-to-month basis.
There is no mandatory long-term commitment for standard monthly service packages.
When the customer authorizes automatic billing, their subscription renews each month until canceled.
Before initiating recurring billing, we disclose the relevant amount, payment frequency, and cancellation arrangements.
Customers may also pay through individually issued invoices where that arrangement is offered.
We do not automatically convert a manually invoiced customer into a recurring payment arrangement without authorization.
11. Cancellation of Services
Customers may cancel a standard month-to-month service at any time before the next scheduled renewal.
Cancellation requests may be submitted by email to:
Where an authorized customer subscription portal is provided, customers may also cancel through that portal.
Cancellation takes effect at the end of the customer's current paid billing period unless the parties agree otherwise.
A timely cancellation request prevents future renewals.
Customers retain the services included in the paid period through its scheduled end, provided that necessary third-party systems and customer access remain available.
Services covered by a separately agreed fixed-term contract are subject to that contract's disclosed cancellation conditions.
For more information, please review our Refund & Cancellation Policy.
12. Refunds and Billing Corrections
We strive to provide transparent and fair billing practices.
Completed work and properly delivered professional services are generally non-refundable solely because a customer did not achieve a preferred business outcome.
However, customers may be eligible for a partial or full refund where services have not been provided, work has not commenced, an incorrect charge has occurred, or another refund right applies.
Refunds are reviewed according to the applicable service agreement, our Refund & Cancellation Policy, and applicable law.
We do not adopt an absolute "no refunds under any circumstances" policy.
Customers can contact [email protected] regarding billing concerns or refund requests.
13. Customer Responsibilities
To deliver our services effectively, we require reasonable customer cooperation.
Customers agree to:
- Provide accurate business and contact information
- Grant appropriate account access and permissions
- Provide requested branding, materials, and approvals
- Maintain applicable third-party payments and subscriptions
- Respond to important requests within a reasonable time
- Ensure that advertised products, services, and claims comply with applicable laws
- Obtain necessary permissions for customer data and communications
- Avoid providing inaccurate or misleading advertising information
Customers remain responsible for the products and services they sell, their own customer transactions, and business decisions.
Missing access, delayed approvals, platform restrictions, or incomplete information may affect our ability to deliver services on schedule.
We will communicate significant issues and work toward a practical resolution.
14. Advertising Performance and No Guaranteed Results
Our goal is to improve our customers' marketing performance and business growth opportunities.
However, advertising outcomes depend on many factors, including:
- Market competition
- Advertising budgets
- Customer demand
- Website quality and conversion performance
- Business pricing and offers
- Sales follow-up and lead handling
- Third-party platform policies and algorithms
- Seasonal and economic conditions
Unless expressly agreed in writing, we do not guarantee a specific number of leads, sales, revenue, conversion rates, return on advertising spend, or search rankings.
Case studies and past customer results are examples of previous work and do not guarantee equivalent results.
We remain responsible for performing the agreed professional services with reasonable care and diligence.
15. Third-Party Platforms and Account Policies
Our services may involve Google, Meta, Microsoft, HighLevel, payment processors, hosting providers, and other independent platforms.
These organizations control their own approval procedures, services, pricing, policies, and enforcement decisions.
We cannot guarantee that advertisements will be approved or that third-party accounts will remain continuously available.
If a platform suspends or restricts an account, we will provide reasonable assistance within our agreed service scope where possible.
We are not responsible for independently imposed platform charges, restrictions, or service interruptions that are outside our reasonable control.
Nothing in this section excludes responsibility for our own negligence, misconduct, or failure to perform agreed obligations where applicable law imposes such responsibility.
16. SMS and Communication Terms
Infinity Digital Solutions LLC may send non-promotional SMS messages to individuals who affirmatively consent to receive service-related texts.
Messages may include appointment confirmations, reminders, requested follow-ups, and service-related notifications.
Message frequency varies.
Message and data rates may apply.
Consent to SMS messages is optional and is not a condition of purchase.
To stop receiving our SMS messages, reply STOP to a message from our SMS program. You may receive a confirmation of your opt-out, after which further messages from that program will stop unless you separately opt in again.
For assistance, reply HELP or contact [email protected].
Mobile carriers are not liable for delayed or undelivered messages.
For information about how we handle personal and messaging information, please read our Privacy Policy available on our website.
These communication terms concern messages sent by Infinity Digital Solutions LLC. Businesses using our CRM services to communicate with their own customers are responsible for maintaining their own lawful consent and communication practices.
17. AI Automation and Communication Responsibilities
AI-powered automation tools are designed to assist business operations but may not always produce complete or accurate responses.
Customers are responsible for reviewing the business information, instructions, permissions, and communication workflows used in their systems.
We will disclose known operational limitations that are material to the agreed services.
Customers must use automated voice, messaging, and marketing systems in accordance with applicable privacy, consent, and telecommunications requirements.
Where required, callers and other individuals must be appropriately informed about AI interaction or call recording.
18. Confidentiality and Data Protection
Both parties agree to handle confidential business information responsibly.
Customer business information, account credentials, customer records, and confidential commercial materials will be used or disclosed only as reasonably necessary to deliver services, fulfill legal obligations, or as otherwise authorized.
Our handling of personal information is described in our Privacy Policy.
We use reasonable safeguards and require appropriate access controls for systems under our management.
19. Portfolio, Case Studies, and Testimonials
We value our customers' trust and respect their branding and business reputation.
We will seek appropriate customer authorization before publicly identifying a customer, using their name or logo, or publishing confidential or nonpublic campaign results as an identifiable case study.
We will not knowingly publish confidential customer information without appropriate authorization.
Anonymous or aggregated performance information may be used only where it does not improperly identify customers or disclose protected information.
20. Additional Services and Scope Changes
Customers may request additional campaigns, AI usage, CRM functionality, creative work, or other services beyond the purchased package.
Additional work may require an additional charge.
We will disclose the applicable scope and charges and obtain customer authorization before proceeding.
A request for additional services does not automatically change an existing subscription unless the customer agrees to the change.
21. Service Pauses and Termination
We may pause services where necessary because of nonpayment, security concerns, unlawful activity, or a material violation of an applicable service agreement.
Where reasonably practical, we will communicate the concern and provide an opportunity to resolve it.
If continued service becomes impracticable or unlawful, we may terminate the affected services with appropriate notice.
Customers will not be charged for unperformed services where a refund is required under our Refund & Cancellation Policy or applicable law.
22. Limitation of Liability
We seek to deliver reliable and professional services.
To the extent permitted by law, Infinity Digital Solutions LLC is not responsible for indirect or consequential business losses arising from circumstances outside our reasonable control.
This may include independently caused third-party platform interruptions, unexpected changes in advertising markets, or customer business decisions.
Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability arising from fraud, willful misconduct, or other legally protected claims.
Any additional limitation of liability in a signed service agreement must be interpreted consistently with applicable law.
23. Dispute Resolution
If you have a concern about our services, deliverables, or billing, please contact:
We encourage customers to raise concerns promptly and provide relevant information so we can investigate and seek a reasonable resolution.
We will review complaints in good faith.
These Terms are generally governed by the laws of New Mexico, United States, except where mandatory laws or applicable consumer protections require otherwise.
Nothing in these Terms removes legal rights that cannot be waived.
24. Changes to These Terms
We may update these Terms as our services or business practices evolve.
Revised Terms will be published on our website with an updated effective date.
Material changes affecting existing customers' contractual or billing obligations will be communicated appropriately, and consent will be obtained when required.
